These Terms and Conditions (“Agreement”) govern participation in the Reimagine Tours® Partners & Affiliates Program (“Program”) offered by Reimagine Tours® . By registering or participating in the Program, you (“Participant”) agree to comply with these Terms and Conditions in full.
Participation constitutes acceptance of this Agreement, as well as any applicable policies, guidelines, or instructions issued by Reimagine Tours® , including our Legal Policies.
1. Definitions
- Partner – Any individual or business listing tours, accommodations, vehicles, or services on Reimagine Tours® to receive bookings or booking/processing fees.
- Tour Guide / Operator – A Partner providing private tours, experiences, or group tours/excursions.
- Other Suppliers – Partners providing accommodations, transportation, vehicles, or other travel-related services.
- Affiliate – Any individual or entity promoting Reimagine Tours® services for commissions on completed bookings.
- Booking – A confirmed reservation facilitated through Reimagine Tours® .
- Deliverables – Any content, marketing materials, or work provided as part of Program participation.
- Confidential Information – Non-public information disclosed to a Participant, including pricing, business practices, and platform functionality.
2. Eligibility
- Participants must be 18 years or older or of legal age in their jurisdiction.
- Compliance with all applicable laws is required.
- Reimagine Tours® may request documentation to verify eligibility.
- Participation can be refused or terminated at Reimagine Tours® ’ discretion.
3. Types of Partners
3.1 Tour Guides & Bus Tours / Tour Operators
- Includes: Private Tour Guides, Group Tour Operators, Bus Tours.
- Guide Payout: Determined by location and tour service in written agreement disclosed to the guide at time of partnership.
- Responsibilities:
- Offer tours exactly as listed.
- Provide all licenses, certifications, permits, and insurance.
- Follow health, safety, and travel regulations.
- Maintain professional conduct, punctuality, and service.
- Maintain world-class service standards and deliver exceptional 5-star tours
- Maintain valid travel documents if needed.
- Notify Reimagine Tours® of any issues affecting tours.
- Responsible for cancellation due to personal or unforeseen reasons. Full tour payment is forfeited to Reimagine Tours® or its partners if the Guide cancels.
- May assign a substitute guide if possible, but original Guide remains responsible.
- Intellectual:
- Grant Reimagine Tours® a non-exclusive, worldwide, transferable license for guide service use.
- Payment:
- Paid only after successful completion of the tour or before tour or per agreement.
- Responsible for own taxes
- Compliance & Conduct:
- No content may include profanity, defamatory, unlawful, misleading, or obscene material.
- Must follow Reimagine Tours® content and advertising policies.
- Non-compliance may result in suspension or termination.
3.2 Other Partners (Accommodations, Vehicles, Airlines, Tour Agencies)
- Includes: Hotels, Hostels, Airbnb & Holiday Rentals, Car/Van/RV Rentals, Airlines.
- Payout / Booking Fee: Reimagine Tours® collects a booking or processing fee; customers book directly using a coupon/booking code.
- Reimagine Tours® acts solely as a booking/referral platform; all refunds, cancellations, or disputes are handled directly between the customer and the Partner.
- Responsibilities:
- Provide services exactly as listed.
- Comply with all applicable laws, health, and safety regulations.
- Notify Reimagine Tours® of any operational changes affecting bookings.
- Provide high-quality content including images, descriptions, and schedules.
- Intellectual Property & Licensing:
- Retain copyright of content but grant Reimagine Tours® a non-exclusive, worldwide license to use content for promotion.
- Liability & Refunds:
- If the Partner fails to provide a booked service, customers must seek refunds or compensation directly with the Partner.
- Reimagine Tours® is not liable for failures by these types of Partners beyond the collected booking/processing fee.
4. Affiliates
- Affiliate Program: Promotes Reimagine Tours® tours and services to earn commissions on valid bookings.
- Types of Affiliates:
- Hotels, Airbnb hosts, and holiday rental managers in cities we operate.
- Tour and travel agencies.
- River and ocean cruise companies.
- Other tourism-related businesses seeking high-quality local tours for guests.
4.1 Affiliate Obligations
- Promote services accurately without false or misleading claims.
- Clearly disclose affiliate relationship per local laws.
- Comply with Reimagine Tours® content, advertising, and branding policies
- Cannot use our logo/photos without express written consent
- Do not bid on Reimagine Tours® trademarks, URLs, or derivatives.
- Provide requested performance metrics (clicks, impressions, bookings).
4.2 Compensation
- Commissions paid only for valid, completed bookings.
- Payment processed per agreed schedule.
- Affiliates are responsible for taxes on commissions.
4.3 Non-Exclusivity
- Affiliates may promote other services if no conflict exists.
5. Content Policy
- Ensure originality and accuracy.
- Obtain permissions for third-party content.
- Avoid profanity, defamatory, misleading, or unlawful content.
- Comply with copyright and trademark laws.
- Properly attribute images or media.
- Do not promote competitors.
- Avoid malicious code, tracking scripts, or cookies without consent.
- Follow Reimagine Tours® content and advertising guidelines.
6. Traveler Communication Rules
- Do not share external contact info with travelers.
- All bookings, payments, and communications must go through Reimagine Tours® unless explicitly authorized.
- Guides and Partners must follow all messaging guidelines to protect privacy and prevent circumvention.
7. Reviews & Ratings Management
- Do not manipulate reviews or ratings.
- No posting of fake reviews or offering incentives for positive reviews.
- Maintain accuracy and professionalism in responses to reviews.
8. Live Virtual Tours (if applicable)
- All virtual tours must comply with quality, content, and technical standards.
- Payment processed only after virtual tour completion.
9. Force Majeure
- Participants not liable for events beyond control (e.g., natural disasters, strikes, pandemics).
- Must notify Reimagine Tours® immediately.
- Reimagine Tours® may reschedule, assign substitutes, or cancel affected bookings.
10. Arbitration & Dispute Resolution
- Disputes should first go through internal support.
- Participants may opt out of arbitration within 30 days of a dispute.
- Internal arbitration scope covers Program obligations and compensation.
11. Payouts & Timing
- Tour Guides & Bus Tour Operators: 70% of tour revenue, paid after tour completion.
- Other Partners: booking/processing fees, paid as scheduled.
- Affiliates: commissions on valid completed bookings, per schedule.
12. Insurance
- Tour Guides, Bus Tour Operators, and Other Suppliers must maintain insurance covering personal liability, property damage, and professional indemnity.
- Third-party contractors must also be insured.
13. Substitute Guides & No-Shows
- Substitute guides may be assigned if available.
- Original guide remains responsible for fulfilling booked tours.
- No-shows result in forfeiture of tour payment.
14. Confidentiality
- Keep all confidential information private.
- Use confidential information only for Program purposes.
- Notify Reimagine Tours® of unauthorized disclosures.
- Breaches may result in legal remedies.
15. Liability & Indemnity
- Participants are independent contractors.
- Tour Guides and Bus Operators are liable for cancellations or failure to provide services.
- Other Partners’ liability is limited to their direct service or booking/processing fees.
- Participants indemnify Reimagine Tours® against claims arising from participation.
- Except as required by applicable law, Reimagine Tours® ’ liability to Participants is limited to €100 for any claim arising under this Agreement.
16. Termination
- Reimagine Tours® may terminate participation at any time without cause.
- Termination does not affect rights to content, confidentiality, or surviving obligations.
17. Governing Law
- Governed by applicable law where Reimagine Tours® operates.
- Disputes subject to competent courts in that jurisdiction.
